Trust in the Danish postal service and the Consumer Ombudsman's statements about and intervention in pending litigation

APCOA Danmark A/S is aware of the Consumer Ombudsman's press release of 25 October 2024. This press release and subsequent press inquiries give rise to the need to provide further information.

Initially, it should be noted that the Consumer Ombudsman's main conclusion is disputed and subject to pending litigation. Lawsuits that are being handled by the two High Courts and which the Consumer Ombudsman is involved in.

APCOA respects the work of the courts and will therefore as a general rule await the decisions in the two High Court cases without further comment.

APCOA does not understand the Consumer Ombudsman's conclusion, which means that neither companies nor private individuals can trust that their postal items will arrive when using authorised mail delivery companies, including PostNord.

APCOA has full confidence in the postal delivery companies, which are authorised in accordance with section 3 of the Postal Act and operate under the supervision of the Ministry of Transport. APCOA also trusts that the Ministry of Transport fulfils its duty of supervision.

Based on the Consumer Ombudsman's statement, it must be noted that Danish companies and citizens, according to the Consumer Ombudsman, cannot trust that mail is delivered correctly. APCOA considers it crucial that the Danish postal delivery companies can be trusted and that consumers and businesses can trust that the mail they pay for is delivered.

The courts have also just confirmed that Danish postal distributors can be trusted. Since January 2022, APCOA has received more than 22 court decisions, all of which refute the Consumer Ombudsman's conclusion.

APCOA is awaiting the High Courts' processing and decision of the two fundamental cases so that it can be definitively established whether Danish companies and consumers can continue to have confidence in the Danish postal service.
